Curious about online "free" poker sites

I'd love to play texas hold'em online, but am a bit unsure of downloading their software - does anyoen know if it's safe, or if there's spyware or malware in it? I'm curious about www.partypoker.net and www.pokerstars.net . Neither has a terms of use agreement online, so I'd have to download the software first to read it. Sorry if I'm in the wrong forum!
