- The man was staggering around after having a few beverages, falls down and is arrested for drunk and disorderly or vagrancy.
- The man attempts to cross the street at a non designated crossing area, is struck by a passing vehicle, falls to the ground and is arrested for Jaywalking.

- This man is unconscious on the sidewalk.
- He was not asleep, He was unconscious.
- He was arrested.
- He was clothed.
- He does not appear to be under the influence of any drugs or alcohol and their is no drub paraphernalia at the scene.
- He did "fall" from a standing position to a prone position.
So it would seem he was resisting arrest, when the officer struck him with his baton knocking the man out, causing him to fall face first to the ground. He was then arrested.
