A man is found lying unconscious on the sidewalk in the retail area of town. Police arrest him. Why?

He didn't "fall" down. (as in falling off of something. He did "fall" from a standing position to a prone position)

No firearms found on or near the unconscious man. No signs of any "gun battle" at the scene. No bullet wounds on/in the unconscious man. The arresting officer had a gun. :D

I have 2 scenarios, :blush:

  • The man was staggering around after having a few beverages, falls down and is arrested for drunk and disorderly or vagrancy.
  • The man attempts to cross the street at a non designated crossing area, is struck by a passing vehicle, falls to the ground and is arrested for Jaywalking.

Unconscious man does not appear to be under the influence of any drugs (which includes alcohol). No drub paraphernalia at the scene. He was not arrested for vagrancy. Do people really get arrested for Jaywalking? In this case it doesn't matter because he was not struck by a vehicle and if he was jaywalking, no body saw him. He was found lying on the sidewalk, not in the street.

indecent exposure, he sleeps in the nude and sleep walks. or obstruction, he was blocking the pavement/sidewalk while sleeping. :popcorn:

Ok, so we know...

  • This man is unconscious on the sidewalk.
  • He was not asleep, He was unconscious.
  • He was arrested.
  • He was clothed.
  • He does not appear to be under the influence of any drugs or alcohol and their is no drub paraphernalia at the scene.
  • He did "fall" from a standing position to a prone position.

So it would seem he was resisting arrest, when the officer struck him with his baton knocking the man out, causing him to fall face first to the ground. He was then arrested. :huh:
